Electronic Communications and Disclosures

1. Introduction

This Electronic Communications and Disclosures Agreement ("Agreement") covers all electronic communications between you ("Customer," "you," or "your") and Abode Awhile ("we," "us," "our") relating to your use of our services, including the submission, processing, and acceptance of your application for our home equity investment services, as well as any other communications related to your account or transactions. By using our services and providing your consent, you agree to receive all communications electronically and to the terms outlined in this Agreement.

2. Scope of Communications to Be Provided in Electronic Form

When you use our services, you agree that we may provide you with any communications, disclosures, agreements, statements, notices, and other information related to your account and our services electronically (collectively, "Communications"). Communications include, but are not limited to:

This Agreement and any updates to it
Our Privacy Policy and any updates to it
Terms of Use and any updates to it
Any legally required disclosures and notices, including those required by federal, state, or local laws or regulations
Customer agreements, policies, and other contractual documents, including updates or amendments
Statements, billing notices, transaction receipts, and payment confirmations
Information regarding your application, the status of your account, and any transactions or services related to your account
Any other information that we need to provide to you in writing

3. Method of Providing Communications to You in Electronic Form

All Communications that we provide to you in electronic form will be provided either (1) via email, (2) by access to a secure website that we will designate in an email notice we send to you at the time the information is available, (3) through your online account, or (4) by requesting you download a PDF file.

4. Hardware and Software Requirements

To access and retain the Communications electronically, you will need the following computer hardware and software:

A device with internet connectivity
A current web browser that includes 128-bit encryption, such as the latest versions of Google Chrome, Microsoft Edge, Mozilla Firefox, or Apple Safari
An email account and email software capable of reading and responding to emails
A PDF reader, such as Adobe Acrobat Reader, to view documents in PDF format
Sufficient electronic storage capacity on your device’s hard drive or other data storage unit

By providing your consent to this Agreement, you confirm that you have access to the necessary hardware and software to receive and retain electronic Communications.

5. How to Withdraw Your Consent

You may withdraw your consent to receive Communications in electronic form by contacting us at:

If you withdraw your consent, we reserve the right to terminate your access to our services, limit your access to certain services, and/or impose additional fees for paper copies. Any withdrawal of your consent will be effective only after we have had a reasonable period of time to process your withdrawal.

6. Requesting Paper Copies

You have the right to request a paper copy of any Communication that we have provided or will provide to you electronically. To request a paper copy, contact us at the address provided above. We may charge you a reasonable service fee for providing you with paper copies.

7. Updating Your Contact Information

It is your responsibility to keep your primary email address current so that we can communicate with you electronically. You understand and agree that if we send you an electronic Communication but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, we will be deemed to have provided the Communication to you.

8. Consent

By consenting to this Agreement, you confirm that you have the ability to access and retain electronic Communications, and you agree to the terms and conditions outlined in this Agreement. You acknowledge that you can access and read this Agreement, and that you are able to print or store a copy for your records.

9. Changes to This Agreement

We may modify or update this Agreement from time to time by providing notice to you as required by law. Your continued use of our services after any changes to this Agreement constitutes your acceptance of the new terms.
